Business relocation: answers to the most common questions
Brief and with sources
Anyone moving a shop, a practice or a workshop usually asks the same questions. The first: do I have to re-register my business? Yes – the relocation must be notified at the same time as the move (§ 14 GewO). If you stay in Berlin, this is a re-registration with the public order office (Ordnungsamt) of the new district; according to service.berlin.de it costs €20, or €15 online. If you leave Berlin, you deregister here and register at the new location. The second concerns the old lease: without a fixed term, you give notice on commercial premises no later than the third working day of a quarter, effective at the end of the following quarter (§ 580a BGB).
The third question is about money: the costs of relocating the business are incurred for business purposes and are therefore business expenses (§ 4 (4) EStG) – keep the quote and the invoice; your tax adviser will clarify the details. And finally liability: under the German Commercial Code, the moving company is liable for up to €620 per cubic metre of goods moved; for refrigerated counters, treatment chairs or machines, additional insurance on request can make sense. Many questions about a business relocation can be answered with a counter-question: who is responsible? We are based in Berlin (Stromstraße 21) and take care of the moving part – survey, fixed price, parking restriction zone, dismantling, transport and reassembly according to your plan. Re-registration, notice, tax, permits and connections for electricity or water are down to you, your tax adviser or your specialist contractor.
