Which shared-flat tenancy agreement applies? What it means for moving out

Before moving out of a shared flat
Read the tenancy agreement first, then plan the shared-flat move
Clearly arranged
Before a shared flat plans the move, it is worth looking at the tenancy agreement: are all flatmates named in it, does one person hold the contract with the others as their subtenants, or does everyone have their own contract for their room? This determines who may give notice, who is responsible for the rent and who hands over the flat. For the transport itself, the type of contract does not matter – we carry out a survey and then give you a fixed price. More under Private move.
If only one person moves out, we collect only their room; if the whole shared flat breaks up, we empty the flat on one or more dates. We dismantle furniture and reassemble it at the new place. Your belongings are covered by liability under the German Commercial Code (HGB) (§ 451e: €620 per m³), and additional insurance is available on request. On request, we apply for the no-parking zone (Halteverbotszone) – in Berlin, the signs must be up at least three full days beforehand.

Fixed price for your shared-flat move after a survey
Look first, then a binding calculation
Call us on 01625978461 and arrange a free survey. We then give you a fixed price for your shared-flat move – for a single room or the whole flat. What is included in the price, such as boxes or furniture assembly, is stated in the quote. That way all flatmates can split the costs fairly from the start.
Offers available individually, depending on effort, scheduling and the scope of services required.

What we take on when you move out of a shared flat
Matched to the contract situation
Depending on the tenancy agreement, a shared-flat move sometimes involves one person and sometimes the whole flat – often on different days. We coordinate the dates to fit the notice and handover and, on request, collect just a single room. We give you the fixed price after the survey; your belongings are covered by liability under the HGB, and additional insurance is available on request. We are based in Berlin (Stromstraße 21) and drive nationwide – you will find destinations with their own page under Locations. Questions about notice or the deposit are best clarified with the landlord or a tenants' association.

What the type of contract changes when moving out
Whether one person may give notice alone in a shared-flat move, who is liable for the rent and who hands over the flat depends on the tenancy agreement. The six points show the differences between a joint tenancy agreement, main tenancy with subletting and individual contracts.

Part load for a single move-out
If every flatmate has their own contract, often only one moves out with few belongings. A part load is then often worthwhile: your belongings travel together with other orders. Your belongings are covered by liability under the HGB in this case too.

Check
the contract, then move
This part of our shared-flat series is about the question that comes before every move-out: which tenancy agreement applies? Under a joint tenancy agreement, everyone decides together; with main tenancy and subletting, one person bears the risk; with individual contracts, everyone is responsible for themselves. Notice, deposit and handover depend on this. You can read what notices must look like formally in the article Terminating a tenancy agreement; long-distance moves of individual flatmates can be found under Long-distance moves.

Frequently asked questions on shared-flat tenancy agreements when moving out
Joint tenancy, subletting, individual contract: the three types
There are three common types of contract in a shared flat. With a joint tenancy agreement, all flatmates are named as tenants in the contract; they make decisions towards the landlord together, and each is liable for the whole rent. With the main tenant and subtenant model, one person signs the contract and sublets rooms – for this they need the landlord's permission (§ 540 BGB).
With individual tenancy agreements, the landlord concludes a separate contract with each resident for one room with shared use of the kitchen and bathroom; each is liable only for themselves. You can tell which type applies by who signed the contract.
What the type of contract means when moving out
Under a joint tenancy agreement, a single flatmate cannot give notice alone. If only one wants to move out, an agreement with the landlord is needed to release them from the contract – according to the BGH, there is no general right to this. With subletting, the subtenant gives notice to the main tenant; with individual contracts, each gives notice to their landlord.
The handover also follows the contract: with a joint contract, everyone signs the handover report or authorises a flatmate; with subletting, the subtenant hands over their room to the main tenant. You will find a template in the article Handover report.
What moving out of a shared flat costs
The exact moving costs depend on many factors, but as a guide: 1-room flats from €339, 2-room flats from €605, 3-room flats from €899 and 4-room flats from €1,329. We calculate larger properties such as houses or villas individually. Where distance has to be taken into account, we charge long-distance moves from €4.20/km. A free on-site survey at your home provides clarity.
