Trouble at the flat handover: what tenants should know

and how to defuse it

Unsere Firma is based in Berlin-Moabit (Stromstraße 21) and often sees how handovers go when people move out – here are the most important rules.

Hardly any appointment around a move causes as much trouble as the flat handover. Landlords and tenants often see the condition of the rooms differently. Typical points of dispute are cosmetic repairs (Schönheitsreparaturen), alleged damage, rawlplug holes and meter readings. Good to know: the tenant does not have to compensate for wear and tear from normal use (§ 538 BGB). If you prepare with photos and a report, you can defuse most conflicts before they arise.

As part of your private move we take care of carrying and transport – the handover itself is a matter between you and the landlord. So schedule it only after the flat has been cleared, so the empty flat can be inspected calmly. A report signed by both sides and your own photos are your most important evidence. Incidentally, the landlord's claims for damage become time-barred six months after the flat is returned (§ 548 BGB).

Empty flat for the handover

A fixed-price move before the appointment

The sooner the flat is empty, the more calmly the handover goes. We take care of packing, carrying and transport at a fixed price after an inventory; if you wish, we take old furniture for disposal. We are liable for damage to belongings under § 451e HGB at €620 per cubic metre. Call us on 01625978461.

Quotes available individually based on workload, scheduling and the desired scope of services.

MAXIMUM CARE

How we help make the handover go smoothly

Empty, carried with care, finished in time

We contribute one thing above all to the flat handover: a flat that is empty in good time and has no new marks. When carrying, we protect door frames and the stairwell, take bulky waste if you wish and are finished before the landlord arrives. You handle the report and the conversation yourself – the advice on this page helps. We give the price as a fixed price after the inventory. Should something be damaged during the move after all, let us know immediately so we can sort it out. We are based in Berlin (Stromstraße 21); destinations with their own page are listed under Locations.

Packing without leaving marks

With our packing service we don't put boxes down on delicate floors, and we dismantle shelves without needlessly damaging walls.

Protection when carrying

Blankets on the furniture, care at door frames and banisters: furniture transport should not cause any new damage to be argued about later.

Dismantling before the handover

We dismantle tenant fixtures such as shelves or kitchen units as part of a move with assembly; check with the landlord beforehand what may stay.

Taking old furniture away

If furniture that isn't meant to come along is still standing around at the handover, there will be trouble. If you wish, we take it away or carry out a house clearance.
WELL PREPARED

Six rules for a handover without disputes

Most disputes at the handover can be avoided if you go into the appointment prepared. These six rules help – from the tenancy agreement to the deposit.

01

Check your tenancy agreement

Is there a clause on cosmetic repairs? Many standard-form clauses are invalid. If in doubt, get advice from a tenants' association before painting.
02

Find the move-in report

Whatever was already damaged when you moved in is in the old report. Without a move-in report, old photos or witnesses help.
03

Normal wear and tear

The tenant does not have to compensate for signs of use in line with the contract (§ 538 BGB). A burn mark in the parquet, on the other hand, is damage.
04

Photos before the appointment

Photograph every room after clearing it, with the date. In a dispute, photos are often the best evidence on your side.
05

Read the report carefully

Only sign what is correct. Cross out or add to points you do not agree with, and ask for a copy.
06

Know the deadlines

The landlord's claims for damage become time-barred six months after the flat is returned (§ 548 BGB). He must settle the deposit within a reasonable time.
FOR SMALL LOADS

Empty in time – even with a shared load

Collection date before the handover

If only part of your furniture is going to another city as a shared load, make sure the collection date is before the handover. Otherwise there will still be furniture in the flat at the inspection, and the handover will have to be postponed – which quickly causes trouble.

THE RIGHT TIMING

The
handover within the moving process

Clear out, inspect, hand over

A good handover starts with the right timing: clear out first, then clean, then inspect. With a long-distance move, moving out and the handover are often close together because the vehicle sets off the same day – plan in a buffer here. How to record the condition room by room is shown in the article Handover report: template. And if there is a dispute about painting work, our article on cosmetic repairs is worth a look.

Before the handover

Find the tenancy agreement and the move-in report, repair rawlplug holes and minor damage as agreed, clean the flat, take photos. If you go into the handover prepared, there is less argument and you can respond to claims factually.

At the appointment

Walk through room by room together, read the meters, count the keys. Write anything disputed into the report as disputed. Report any new damage caused by the furniture transport to the moving company immediately – not weeks later.

After the handover

Keep a copy of the report, request the deposit back in writing, wait for the statement. The landlord's claims for damage become time-barred six months after the flat is returned (§ 548 BGB); in a dispute, a tenants' association can help.

FAQ

Questions about disputes at the handover

Cosmetic repairs, report, liability, witnesses, deposit, keys and deadlines – answered briefly.
First check whether cosmetic repairs were validly transferred to you in the tenancy agreement – many standard-form clauses are invalid, for example those with rigid intervals or where the flat was handed over unrenovated. Document the condition with photos and insist on a report. In a dispute, a tenants' association or a tenancy lawyer can help.

The most common causes of disputes at the handover

Conflicts usually flare up over cosmetic repairs, alleged damage to walls, floors or sanitary fittings and disputed meter readings. If there is no move-in report, nobody can later prove what the flat looked like when the tenant moved in. Important: the tenant is not responsible for wear and tear from use in line with the contract (§ 538 BGB).

Another classic point of dispute is the deposit. The landlord may not withhold it without giving reasons, but does not have to pay it straight away either: he may take a reasonable time to check whether any claims remain. With a report, photos and clear agreements, many conflicts can be avoided.

How to resolve the conflict in practice

Stay factual at the handover and insist on a written report signed by both sides. Have anything disputed expressly noted as disputed instead of simply accepting it. Photos and videos of the flat's condition are strong evidence; a neutral witness can confirm how things went.

If a dispute arises anyway, a factual conversation with the landlord helps first, ideally in writing. If that gets nowhere, tenants' associations or lawyers specialising in tenancy law can advise. Keep the deadline in mind: the landlord's claims for damage become time-barred six months after the flat is returned.

Your move – your price

Every move is different – which is why our prices depend on the size of the flat: 1 room from €359, 2 rooms from €584, 3 rooms from €894 and 4 rooms from €1,324. For houses and villas we prepare an individual quote. If you are moving to another city, we charge long-distance moves from €3.95/km. Arrange a free survey today.

How volume, distance & co. affect your moving price

The volume largely determines the effort, while the distance enters the calculation at €3.95/km. The floor, lift and a possible parking restriction zone also count. In addition, we offer furniture assembly and shared load.
