Replacement tenant
Finding a replacement tenant: out sooner if the landlord plays along
Law and practice
Anyone who wants to move out before the notice period ends often hopes for a replacement tenant (Nachmieter). As a rule, however, there is no legal right to one: without a replacement tenant clause in the lease, the landlord does not have to accept anyone, and the regular three-month notice period applies. Many landlords still agree if a solvent candidate with complete documents is ready – ask early and in writing.
If the landlord agrees, they usually sign a new lease with the replacement tenant and a termination agreement with you. Make sure both state in writing from when your obligation to pay rent ends. If the replacement tenant is asked to pay a transfer fee for furniture, the price must not be grossly disproportionate to its value (§ 4a WoVermittG). We plan the move itself with our private move as soon as the date is fixed.

Fixed price after a survey, date set by the handover
While you look for a replacement tenant, we plan the move. After a survey we quote a fixed price and set the date as soon as the end of the tenancy is fixed. Call us on 01625978461; destinations outside Berlin can be found under Locations.

Once the landlord has agreed
Termination, handover, moving day
A change of tenant often happens under time pressure: first the landlord says yes to the replacement tenant, then the move-out date is set, then the move has to fit. We are based in Berlin-Moabit (Stromstraße 21), quote a fixed price after the survey and schedule moving day around the agreed handover date. We are liable for your household goods under § 451e HGB at €620 per cubic metre; you carry out the flat handover with a handover report together with the landlord.

How your replacement tenant convinces the landlord
A replacement tenant convinces the landlord with good credit and complete documents. These six points help ensure the landlord agrees – and that nothing goes wrong during the changeover, from the first enquiry to the handover report.

There are further questions around finding a replacement tenant: how long is the regular notice period if the landlord says no? When will the deposit be returned? The answers are in our guides Terminating a lease and Rental deposit. If you are moving further away, you will find routes from Berlin under Long-distance moves.

Frequently asked questions about replacement tenants
Legal basis: no entitlement without a clause
As a rule, there is no legal entitlement to leave a lease early by providing a replacement tenant. It exists mainly if the lease contains a replacement tenant clause; without a clause, the landlord decides freely whether to accept a candidate. They may take solvency and reliability into account and reject a replacement tenant if there are well-founded doubts.
Put all arrangements in writing: the landlord's consent, the termination agreement with the date from which your obligation to pay rent ends and, where applicable, the agreement on furniture taken over. If someone demands money just for you vacating the flat, this is invalid (§ 4a WoVermittG); proven moving costs may be reimbursed. If in doubt, a tenants' association (Mieterverein) can help.
How to find the right replacement tenant
A replacement tenant is often found fastest among family and friends, because trust already exists. Online portals and notices reach more interested parties; an advert with photos, floor plan, rent and move-in date saves unnecessary viewings.
Ask applicants for a tenant self-disclosure form, proof of income and a copy of their ID, often a credit report as well, and submit the documents to the landlord together. This increases the chance that they will accept the replacement tenant and that your move-out date becomes predictable. Set your moving date as soon as you have the consent in writing.
